Option 2: Lease Agreement Consent
If your lease agreement with your property manager already includes a clause stating that you agree to receive SMS messages from the landlord or their authorized service providers (including ResiDesk), no further action is required. Please review your lease to confirm.
Sample clause: "Resident agrees to receive text messages from the landlord or its service providers. Message and data rates may apply. Reply STOP to unsubscribe."
Why we are allowed to text you:
- Provision of Phone Number: When residents provide their phone number in the lease agreement, they are knowingly giving this information to the landlord or property manager during the normal course of business. (source)
- Implied Consent for Non-Marketing Communications: The FCC has stated that if a customer provides their mobile number, consent is implied for informational or transactional messages. (source)
- Scope of Implied Consent: This includes non-marketing messages directly related to the lease, such as rent reminders or maintenance alerts. (source)
- No Express Written Consent Required: Because the messages are informational (not promotional), express written consent is not necessary under TCPA rules. (source)
